Terms of Service

These Terms of Service ("Terms") are an agreement between you and Global Speaking Group LLC ("VIP Speech", "we", "us") and govern your use of the VIP Speech mobile app and this website (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who can use VIP Speech

You must be at least 18 years old to use the Service. VIP Speech analyzes video recordings of you with AI to provide coaching, so the Service is designed for adults only. By using it, you confirm that you are 18 or older and that you can form a binding contract with us.

2. Your account

You are responsible for keeping your login details secure and for activity that happens under your account. Tell us promptly if you believe your account has been used without your permission. You agree to give accurate information and to keep it up to date.

3. The license we give you

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial learning and practice, subject to these Terms.

4. Acceptable use

You agree not to:

break the law, infringe others' rights, or upload content you do not have the right to share;
record or share other people without their consent;
post content that is harassing, hateful, abusive, sexually explicit, or otherwise objectionable;
attempt to access other users' data, disrupt the Service, or get around security or usage limits;
copy, resell, or reverse engineer the Service except where the law allows.

5. Your content and recordings

You keep ownership of the recordings and other content you create ("Your Content"). You grant us a limited license to host, store, process, and display Your Content only as needed to run the Service for you, for example to provide AI coaching when you request it and to show content you choose to share. How recordings are handled, including when they are uploaded for AI review or sharing, is described in our Privacy Policy.

If you share content with friends or on a leaderboard, you give those people the ability to view it within the Service. You are responsible for what you choose to share. You can delete Your Content as described in the app.

6. AI coaching is feedback, not professional advice

VIP Speech provides automated feedback to help you practice. Scores and suggestions are generated by AI and may be incomplete or wrong. They are for self-improvement only and are not professional, educational, medical, or career advice. Use your own judgment.

7. Gems and virtual items

The app uses "gems" to meter certain features, such as in-depth AI reviews. Gems are a usage allowance included with your subscription or granted by us — they are not sold separately, and the app does not offer gems for purchase. Gems have no cash value, cannot be exchanged for money, and cannot be transferred outside the app. We may change how virtual items work, subject to applicable law. Gems are licensed to you, not sold.

8. Subscriptions, billing, and renewals

VIP Speech is offered as an auto-renewing paid subscription ("Pro"), currently USD 12.99 per month or USD 99.99 per year. The exact price and billing period for your region are shown in the app before you buy. New subscribers get a 7-day free trial where the store offers it. Subscriptions are sold through the Apple App Store or Google Play and are subject to their terms.

Payment is charged to your app store account at confirmation of purchase — or, if your purchase starts with a free trial, when the trial ends.
Your subscription renews automatically for the same period unless you turn off auto-renew at least 24 hours before the end of the current period (including before the end of the free trial, if you do not want to be charged).
Your account is charged for renewal within 24 hours before the end of the current period.
You can manage or cancel your subscription in your App Store or Google Play account settings after purchase.
Any unused portion of a free trial, if offered, is forfeited when you buy a subscription.

Refunds are handled by Apple or Google under their policies, not by us directly. If you have a billing question, contact the relevant app store.

9. Third-party services

The Service relies on third parties such as our hosting, video storage, AI, and payment providers. Your use of the Service may also be subject to the app stores' terms. We are not responsible for third-party services we do not control.

10. Our intellectual property

The Service, including its lessons, text, design, logo, and software, belongs to us or our licensors and is protected by intellectual property laws. These Terms do not give you any rights in our brand or content except the limited license above.

11. Suspending or ending access

You can stop using the Service and delete your account at any time directly in the app. We may suspend or end your access if you break these Terms or use the Service in a way that could harm others or us. When your account ends, the license in Section 3 ends, and we handle your data as described in the Privacy Policy.

12. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and that the Service will be uninterrupted, error-free, or that AI feedback will be accurate. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.

13. Limitation of liability

To the fullest extent allowed by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD 100. Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnity

You agree to cover reasonable losses we incur from your misuse of the Service or your breach of these Terms, to the extent allowed by law.

15. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Disputes will be handled by the courts of Sheridan County, Wyoming, United States, unless your local consumer law gives you other rights.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you in the app. Continued use after a change means you accept the updated Terms.
